S.1 Attendance & Work Schedules



S.1.1 Work Schedules - Non-Exempt Staff.

(Arkansas State Personnel Policy; Governor’s Policy Directive #5; Federal Fair Labor Standards Act - Public Law 99-150 of 1986) To maintain compliance with the federal Fair Labor Standards Act (FLSA), work schedules that deviate from normal must be approved by supervisory personnel and the director of Human Resources. Schedules will, in all cases, conform to a normal work schedule in terms of total days and total hours worked per week by the employee.

An employee’s specific work schedule, including days off and meal breaks, is determined by their immediate supervisor and based on departmental needs. A normal full-time work schedule does not typically exceed 40 hours or five (5) days in one week; however, there may be occasions when employees will be required to work overtime hours and/or an altered schedule.

Any questions about work schedules should be referred to the appropriate supervisor.

S.1.1.1 Workweek.

The workweek begins at 12:01 a.m. Sunday and ends at midnight Saturday.

S.1.2 Work Schedules - Other Exempt Staff.

Full-time exempt staff are expected to carry a commitment of at least 40 hours a week; in many cases, however, additional hours may be necessary in order to satisfactorily fulfill the requirements of a job. Exempt staff are not eligible for overtime or comp time.

S.1.3 Overtime.

(Federal Fair Labor Standards Act - Public Law 99-150 of 1986; ACA §19-4-1612; Arkansas State Personnel Policy) Only non-exempt employees receive credit for overtime work. If a non-exempt hourly employee works more than 40 hours in any workweek, they accrue compensatory time or, in rare cases, receive overtime pay at a rate of one-and-one-half hours for every hour of work performed in excess of 40 hours (43 hours for University Police Department personnel).

Non-exempt employees shall not work more than 40 hours in any workweek without the prior approval of their supervisor. For more information refer to E.3.10. Compensatory Time and Overtime for Non-Exempt Classified Staff.
